These Terms and Conditions govern the sale by Rocky Mountain Wine Spirits Beer (RMWSB) to you of products through the rockymountainwinespiritsbeer.com and or rmwsb.com website. Rocky Mountain Wine Spirits Beer reserves the right to change these Terms and Conditions at any time without prior notice by posting changed Terms and Conditions of Sale on rockymountainwinespiritsbeer.com and/or rmwsb.com. You are advised to review the website regularly for any changes. These Terms and Conditions of Sale were last updated on October 31, 2020. By placing an order through the Rocky Mountain Wine Spirits Beer website, you agree to be bound by the Terms and Conditions of Sale in effect.

ALCOHOLIC BEVERAGES PURCHASED FROM ROCKY MOUNTAIN WINE SPIRITS BEER ARE SOLD IN ALBERTA AND TITLE PASSES TO THE BUYER.

Rocky Mountain Wine Spirits Beer makes no representation to the legal rights of anyone to import alcoholic beverages into any province outside of Alberta. It is solely the buyer’s responsibility for the shipment or importation of alcoholic beverage products. By placing an order, the buyer authorizes RMWSB on the buyer’s behalf, to hire a common carrier such as Canada Post to deliver the buyer’s parcel. It is the buyer’s responsibility to be aware of the liquor laws in the province they reside in.

BOTTLE/CAN DEPOSIT

The Beverage Container Recycling Program was implemented in Alberta on December 1, 1997. RMWSB must charge a bottle recycling fee on all recyclable bottles and cans. The bottle/can deposit fees are as follows per item:

• Up to 1 litre: 10¢
• Over 1 litre: 25¢

We do our best to accurately display the recycling charge for each item on our site. If there is a discrepancy, please proceed with your order and contact us at [email protected].

By submitting your order, you agree that you are authorized to use the designated credit card and you authorize the Rocky Mountain Wine Spirits Beer to charge your order to that credit card. When entering your billing information during the checkout process, you must enter the billing address associated with the credit card being used for purchase. Rocky Mountain Wine Spirits Beer reserves the right to obtain authorization from the issuer of that credit card and reserves the right to decline to accept any credit card transaction.

AVAILABILITY

Every effort has been made to stock adequate quantities of the products offered on Rocky Mountain Wine Spirits Beer website. However, some products are available in very small quantities. Some items referred to on the Rocky Mountain Wine Spirts Beer website may become unavailable without notice.

If Rocky Mountain Wine Spirits Beer is unable to fill an order through the website, you will be notified by email and we will issue a refund on your credit card for the products that were unfulfilled and/or offer an alternative product, and the customer can choose to accept the alternative or have a refund for that product only.

ORDER QUANTITIES

PRICING

SHIPPING

You will be contacted by email once your order has shipped or is ready for pick up. When you pick up products in-store, you must present a government-issued photo ID, along with proof of legal drinking age. Products will only be delivered to, and may only be picked up by, a person 18 years of age or older, who is not or does not appear to be intoxicated.

If you choose to ship your products using Canada Post, and are not home when they deliver, your product will be taken to the nearest postal location. You will need photo id for proof of age and pick up.

Title to products passes from Rocky Mountain Wine Spirits Beer to you when you pick up the products from our location at 225 58th Avenue SE Calgary, receive them at the designated delivery address in your order, or retrieve them from a Canada Post location.

ERRORS

Rocky Mountain Wine Spirits Beer works hard to ensure that information on our website rockymontainwinespiritsbeer.com and/or rmwsb.com is displayed accurately. No warranty of accuracy or completeness is expressed or implied. Rocky Mountain Wine Spirits Beer reserves the right to correct errors and to change or update information on our websites (listed immediately above) at any time without notice. If a product offered on our website is not as described, consumers may return it within thirty (30) days for refund showing proof of purchase and valid, government-issued photo ID to verify identity.

In the event of an error in an order confirmation, in processing an order, in delivering a product or otherwise, Rocky Mountain Wine Spirits Beer reserves the right to correct your order accordingly or to cancel the order and refund any amount charged to you.

DISCONTINUANCE

Rocky Mountain Wine Spirits Beer reserves the right to discontinue, whether temporarily or permanently, any currently available products listed at any time without prior notice.

IMPORTANT: If a customer fails to pick-up an order within 30 days of the first notification for pick-up, Rocky Mountain Wine Spirits Beer may cancel your order and issue a refund to the credit card originally used to make the purchase.
